La mujer inició una demanda por paternidad hace 12 años, pero sucesivos recursos presentados por los abogados de María Estela Martínez de Perón, su tercera esposa, impidieron la realización de los análisis. Finalmente, ayer la Justicia civil ordenó que los estudios se pusieran en marcha. “Estoy contenta, exultante, feliz”, expresó Holgado, en declaraciones a Página/12.
La exhumación del cuerpo de Perón fue ordenada en la década del ’90 por la Cámara Nacional de Apelaciones en lo Civil. ¿Qué detuvo el proceso desde entonces? Según los abogados de Holgado, la causa fue “la obstinada actitud de María Estela Martínez y de su letrado, Humberto Linares, quienes se han opuesto sistemáticamente” a que se realice el ADN.
Ahora, la titular del Juzgado Nacional de primera instancia en lo Civil Nº 38, Mirta Ilundaín, ordenó la realización de las pericias: se trata del examen de ADN y la pericia antropomórfica que había pedido la defensa de Holgado. En su resolución, la jueza consideró que “se han incorporado nuevos materiales que permiten formar convicción en orden a que queda habilitada la realización de las pruebas periciales”.
Abierto el camino legal, resta acordar con el juez penal Alberto Baños el momento en que se realizarán los análisis. Ocurre que es ese magistrado quien tiene en custodia el cadáver de Perón, desde que sufrió la amputación de sus manos, en 1987. Se estima que las pericias podrían hacerse en un mes, un plazo considerado “razonable” por la defensa.
Arturo Podestá, uno de los defensores de Holgado, señaló ante Página/12 que “se trata de una prueba común para las dos partes, dado que Isabel Martínez dice que mi clienta no es la hija de Perón. Si no es, se le dará la razón”, argumentó. En este sentido, agregó: “¿Cuál es el interés de que no se haga la pericia? No hay ningún antecedente en el país de una prueba de este tipo que tarde doce años”, aseguró. Y se anticipó al futuro al plantear que “si mañana se opusiera el abogado de Isabel, lo primero que le digo es que la medida no es apelable, porque así se estableció en otro caso”.
De acuerdo con el testimonio de Holgado, su madre se casó en 1928 con el hombre que le dio su apellido. El matrimonio tuvo una hija que falleció a los pocos meses de nacer, “y eso terminó en una separación”, contó a este diario. “Mi madre volvió a vivir con su mamá y en ese período conoció a Perón en la casa de unos amigos comunes. Se enamoraron en el ’32, ’33 y yo nací en el ’34.” Pero cuando su madre estaba embarazada retomó la relación con su marido, quien crió a Martha como una hija propia.
Según Holgado, fue el propio Perón quien le contó “la verdad de todas las cosas” cuando ella tenía 19 años. “Un día fui decidida a decirle que padre no es el que engendra, sino el que cría. Cuando me explicó la verdad lo entendí: él tenía un gran poder de convicción –afirmó–. Más tarde mi madre me confirmó todo.” De allí en más, la relación habría continuado. “Yo me llevaba muy bien, lo seguí en Paraguay después del exilio, lo fui a ver a Venezuela, a Caracas, a Santo Domingo, a Paraná. Hasta el final, cuando no me dejaron López Rega e Isabel”, indicó.
“Ninguna relación extramatrimonial es un hecho público, ni tiene testigos”, observó su abogado, Podestá. “No obstante, la ley contempla que puede existir la apariencia de verosimilitud y razonabilidad del reclamo filiatorio. Nosotros tenemos testigos calificados”, insistió.
Uno de esos testimonios fue el de “Ema Tacta, dos veces senadora. Contó que estando en Puerta de Hierro, Perón dijo que tenía una hija, frente a Isabel y López Rega. Ella es abogada, y no va a presentarse a brindar un testimonio falso”, opinó. También se presentó una enfermera, Mercedes Grosso. Ella aseguró que la madre de Perón le dijo, en la década del ’50, que tenía una nieta. El último testigo en declarar fue Hevamd Jonch, un ortopedista que atendió a la esposa del general Eduardo Lonardi. Ella le habría contado el mismo secreto: Perón se lo habría dicho a su marido. “¿Tantos testigos hacen falta para una pericia de ADN?”, se preguntó el letrado.
